This State Privacy Addendum explains how and why Paramount collects, uses, and shares the information through our websites and mobile applications, including Paramoutfinancial.com (our “Sites”), through your use of our services, as well as from your interactions directly with us (collectively, our “Services”).  For more information about our privacy practices generally, please view our Privacy Policy.

This State Privacy Addendum also incorporates the protections afforded by various states within the U.S., including California, Colorado, Connecticut, Montana, Oregon, Texas, Utah and Virginia, and contains information required by the laws of these respective states (collectively, “U.S. State Data Protection Laws”), as amended or replaced from time to time, along with any implementing regulations. 

This policy includes the information and disclosures we are required to provide to you under U.S. State Data Protection Laws as residents of the above-mentioned states (“Applicable Residents”), including your rights to (1) know whether we sell or share your Personal Information and opt-out of a sale or sharing of your Personal Information with a third party, (2) to receive an overview of the Personal Information we collect, how we use it, and who we share it with, (3) limit the use and sharing of your sensitive Personal Information, (4) access your Personal Information and get a copy of it, (5) correct inaccurate Personal Information, (6) delete your Personal Information, and/or (7) personally, or through an authorized agent to contact us if you have a question at privacy@paramountfinancial.comYou should read it carefully.  The terms “you,” “your” or “user” means the Applicable Resident users of the Site and Services as addressed in this State Privacy Addendum.

Paramount applies certain privacy controls to all U.S. customers. For example, all customers can control their privacy settings in their Account Settings as well as other features as described in our Privacy Policy. This notice makes sure we cover state-specific requirements. In the event of any conflict between the terms of this notice and the Privacy Policy concerning residents of the states identified in the title of this State Privacy Addendum, the terms of this notice prevail.

What is Paramount

Paramount Financial Services, LLC (“Paramount,” “we,” “our,” or “us”) provides financial services to businesses and consumers throughout the United States.   At Paramount, your privacy is important to us, and we are committed to protecting it. 

1. The Scope Of This State Privacy Addendum

What Is Personal Information?

“Personal Information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Applicable Resident or household.

Whose Personal Information Is Covered By This Policy?

This State Privacy Addendum applies to the Personal Information of Appliable Residents in their capacity as consumers, which includes both our customers and their legal guardians where applicable, and where applicable, guests users (for purposes of this State Privacy Addendum these individuals are referred to as “Consumers”).

What Personal Information Does This State Privacy Addendum Cover?

This State Privacy Addendum applies to all Personal Information of Consumers that we collect both online and offline, including through Consumers’ (a) visits to our www.paramountfinancial.com website (“Website”) or any mobile application (“Mobile App”), and (b) use of our services and products that references this State Privacy Addendum (collectively, the “Services”).

Whose Personal Information Is Not Covered By This State Privacy Addendum?

For purposes of this State Privacy Addendum, “Consumer” does not include:

  • Applicable Residents who are Paramount’s employees, job applicants, owners, directors, officers, fitness staff members, or contract workers (collectively, “HR Individuals”), or the emergency contacts of HR Individuals or the dependents or spouses who receive Paramount benefits by virtue of their relationship to an HR Individual in their capacities as HR Individuals or emergency contacts, dependents, or spouses; or
  • Applicable Residents who are employees or other agents of a business engaged in a transaction with Paramount in their capacities as employees or agents of that business.
  • Personal Information that is excluded from the scope of the California Consumer Privacy Act, such as information subject to the federal Fair Credit Reporting Act (FCRA).

What Else Should I Know About Paramount’s Handling Of Consumers’ Personal Information?

2. Paramount’s Collection, Use and Disclosure of Personal Information

This section of the State Privacy Addendum describes, for the 12 months preceding the date last updated, above, (a) the categories of Personal Information we have collected about you, (b) the sources of that Personal Information, (c) the business and commercial purposes for use, and (d) the categories of third-party recipients of your Personal Information. 

Unless we inform you otherwise, this section also serves as our “Notice at Collection” by informing you of your Personal Information to be collected in the future and the purposes for its use.

a) Categories Of Personal Information Collected

In the last 12 months, Paramount collected the following categories of Personal Information about Consumers:

  • Identifiers, including certain information from registration information and information contained in Web-Behavior Information and/or user content such as your real name, postal address, unique personal identifier, online identifiers, Internet Protocol address, email address, phone number, ATM debit card and credit card information, credit information.
  • Categories described in Cal. Civ. Code § 1798.80(e) (except those already listed in “Identifiers” above), including: government issued ID including driver’s license number, passport number, social security number or ITIN, military ID, signature.
  • Characteristics of protected classifications under U.S. State Data Protection Laws or federal law, including certain information from: date of birth, your financial information, other personal information or history that you provide to us at your discretion; and other information about your past, present or future financial status.
  • Commercial information, including certain information from Self-Reported Information and/or User Content such as: products and services purchased, obtained, or considered, survey responses regarding past purchasing history, information about products you purchased or considered, or other purchasing or consuming histories or tendencies.
  • Audio, electronic, visual, thermal, olfactory, or similar information: Certain information from Self-Reported Information and/or User Content you provide to us through surveys or other engagement on our platform, such as when you upload a profile picture.
  • Professional or employment-related information: Certain information from Self-Reported Information and/or User Content such as education, household income, business income, occupation, and other professional information. This information can be collected when you fill out a survey, or otherwise engage with us.
  • Internet or other electronic network activity information, including: internet connection, equipment used to access our Services, WiFi usage and related IP address, and other information as described under section 6.3 of Paramount’s Privacy Policy
  • Responses To Questions, including information from you on forms within our Website and Mobile App. including registration, subscriptions to Services, posting material, technical reports or issues, study responses.
  • Internet or other electronic network activity information: Web-Behavior Information such as data generated from your use of our Services and collected through log files, cookies, web beacons, and similar technologies. Such information may include your browser type, domains, page views, how long you spent on a page or feature of the website, or other data about your engagement with our Services.
  • Geolocation data: Web-Behavior Information that includes the identification or estimation of physical location or movement.
  • Inferences drawn from other personal information: Inferences and Derived Data includes any information, data, assumptions, or conclusions Paramount infers based on analyses of facts, evidence, or another source of information or data.
  • Sensitive personal information: Genetic Information, and certain Registration Information, Sample Information, and Self-Reported Information may be considered “sensitive.” This includes data that reveals your: social security, EIN, tax information and filings, driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to your account; precise geolocation; racial or ethnic origin, religious or philosophical beliefs, or union membership; and mail, email, and/or text messaging contents where Paramount is not an intended recipient.

d) No Sale of Personal Information

Paramount does not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this CA Notice. We disclose your Personal Data to a few third parties, including: Paramount’s affiliated partners, Paramount’s parent, subsidiaries and affiliates, third-party service providers, subcontractors, and business associates whom we are engaged with in order to provide services to you and to support our business, to the extent of a merger or acquisition, to the new owner(s) of Paramount or any company purchased by, or merged with Paramount, those agencies to which we are required to disclose by law or to comply with legal obligations, companies hired or used to enforce our legal rights, to parties with whom you have provided your express consent. We may also share information to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce our Terms of Use or the Mobile App’s End User License Agreement, for billing and collection purposes, and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of you, your licensed provider and/or her/his staff, Paramount Financial Services LLC, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

3. Your Privacy Rights as Applicable Residents

As an Applicable Resident, when we use the term “Personal Information” in this State Privacy Addendum, we are referring to any information that identifies, relates to, describes, is capable of being associated with you, or could reasonably be linked, directly or indirectly, with you, and as otherwise defined in the U.S. State Data Protection Laws.  Please note, the U.S. State Data Protection Laws do not consider publicly available information, deidentified, or aggregate Consumer information as “Personal Information.”

a) Right to Know: You have the right to submit a verifiable request to know:

  • The categories and overview of the Personal Information about you that Paramount has collected or uses, how we use it, and who we share it with;
  • The categories of sources from which Paramount collected the Personal Information;
  • The categories of Personal Information that Paramount sold, shared, or disclosed to a third party (other than a service provider) for a business purpose and the categories of recipients of that information; and
  • The business or commercial purposes for Paramount’s collection, disclosure, or sale of the Personal Information.

b) Right To Delete 

  • You have the right to submit a verifiable request for deletion of Your Personal Information that Paramount has collected from you.

c) Right to Access Your Personal Information

  • You have the right to submit a verifiable request to receive a copy of your Personal Information in a portable, and if technically feasible, readily usable format.

d)  Right to Opt Out of: 

  • The sale of the Personal Information. 
  • Targeted advertising; the sharing of your Personal Information with third parties; and/or, profiling in the furtherance of decisions that produce legal or similarly significant effects. 

e) Right to Limit

  • The use and sharing of your sensitive Personal Information. Sensitive Personal Information includes, but is not limited to, Personal Information that reveals your racial or ethnic origin, religious beliefs, mental or health conditions or diagnosis, sex life or sexual orientation, citizenship or immigration status, genetic data, precise geolocation, or as otherwise defined in applicable U.S. State Data Protection Laws. Your Paramount Registration Information and Self-Reported information likely include sensitive Personal Information.

4. How to Exercise Your Rights

Requests By Consumers

You may change your settings and select your privacy preferences as described in this State Privacy Addendum, or contact Paramount directly.  

Paramount will respond to Consumers’ requests in accordance with applicable law if it can verify the identity of the individual submitting the request. Applicable Residents can direct these requests or inquiries to us by emailing us at Privacy@paramountfinancial.com or if you have created a Mobile App account, by logging into your Mobile App (where changes can similarly be made through your Account Settings).  If you email us, please describe your request (e.g., right to know or right to delete) with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Requests By Authorized Agents

You can have an authorized agent submit a CCPA privacy request to us on your behalf by (a) providing us with a written authorization signed by you that designates the agent as your authorized agent for purposes of a CCPA request; (b) verifying your identity directly with us; and (c) directly confirming with us that the agent is authorized to submit the request.

How We Will Verify Your Requests

To prevent anyone other than you, or your authorized agent, from exercising the right to know or the right to delete with respect to your personal information, we follow procedures to verify your, or your agent’s, identity. This process seeks to confirm that the person making a request is the person about whom we have collected personal information or that person’s authorized agent. The verification process involves matching data points that you provide with your request against information about you we already have in our records and that we have determined to be reliable for purposes of verifying your identity. We will use information you provide in your completed request to verify your identity, and we may request additional information if necessary to complete the verification process. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

5. Paramount’s Non-Discrimination Policy 

All Paramount customers, including Consumers have the right not to be subject to discriminatory treatment by Paramount for exercising their privacy rights under the California Consumer Privacy Act or other US State Data Protection Laws, and Paramount will not discriminate on that basis. However, where permitted under state law, Paramount may charge an Consumer a different price or rate or provide a different level or quality of goods or services if the difference is reasonably related to the value provided to the Consumer by the Consumer’s Personal Information. If Paramount does so, it will provide Consumers with any legally required notice. Your Right to Information About Disclosures of Personal Information for Direct Marketing Purposes.

Under Certain US State Data Protection Laws, Consumers can request information from us whether we have disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. As described herein, we will not sell your Personal Information to, or share it with, third-party companies for their direct marketing purposes without your consent. Consumers desiring to request further information about our compliance with these laws or who have questions or concerns about our privacy practices and policies are welcome to contact us using the contact information below.

6. Notice of Right to Opt-Out of Sale/Sharing

Like many websites, Paramount uses cookies (including other tracking technologies) for targeted or cross-context behavioral advertising. Cookies require your Web-Behavior Information to work.

Under the CCPA, this use of your data for cross-context behavioral advertising may constitute a “sale” or “sharing” of personal information.  We let advertising providers collect identifiers (IP addresses, cookie IDs, and mobile IDs), activity data (browsing, clicks, app usage), device data, and geolocation data through our sites and apps when you use our online service. In the past 12 months, these categories of personal information may have been “sold” or “shared” as defined under CCPA. We do not have actual knowledge of selling or sharing personal information of users under the age of 18. Paramount believes in providing you with a frictionless experience by responding to Global Privacy Control (“GPC”) signals sent by your browser or mobile device. A GPC is a signal from your browser that notifies us of your privacy preferences, such as whether or not you want us to drop cookies on your device. 7. Notice of Financial Incentive

We may provide special offers and benefits to certain customers. For example, a customer may be invited to get a discount code or special promotion. Such offers and benefits are voluntary and customers can choose not to accept the promotion. If a customer accepts a promotion, they can choose to close their account at any time via Account Settings or by contacting us at privacy@paramountfinancial.com.  We collect the same Personal Information from a customer with promotion as those who do not receive promotions. Both customers’ Personal Information will be handled as detailed in this Policy.

While we do not assign a monetary value to the personal information we collect from a customer with a promotion, we do receive value in the form of customer loyalty, and increased engagement. The value of the personal information that we collect is reasonably related to the expenses related to our offering to you. This value will vary by customer depending on their engagement on the Paramount Services, and many other factors.

8. Changes to This State Privacy Addendum 

If we change this State Privacy Addendum, we will post those changes on this page and update the State Privacy Addendum modification date above. If we materially change this State Privacy Addendum in a way that affects how we use or disclose your personal data, we will provide a prominent notice of such changes and the effective date of the changes before making them.

‍10. No Rights of Third Parties

This online State Privacy Addendum does not create rights enforceable by third parties.

11. California’s Shine the Light Law

California Civil Code Section 1798.83, known as the “Shine the Light” law, permits Users who are California residents to request and obtain from us a list of what Personal Information (if any) we disclosed to third parties for their direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests by California resident Users may be made only once a year and are free of charge. Under Section 1798.83, Paramount currently does not share any Personal Information with third parties for their own direct marketing purposes.
